Personal injury claims

by | Oct 30, 2015 | Firm News

For a viable personal injury claim two questions must be answered:

  1. Whether an individual or corporation was liable for the accident
  2. Whether the accident caused some form of injury.

If the answer to both of these questions is yes, then you are probably entitled to some form of compensation.

The most typical personal injury claims are auto accidents and slip and falls. To make a claim for either one, you need to know the following:

Auto Accidents
Drivers have a duty to other drivers and pedestrians to drive carefully. If a driver fails to do so, the duty to the other drivers and pedestrians has been breached. In other words, if the carelessness of another driver has caused you to get injured, then you might have a claim against that driver.

Slip And Falls
Property owners have a duty to maintain their premises free from any hazards. If property owners fail to maintain the premises in a safe condition and you are injured due to the unsafe condition, you might have a compensable claim against that property owner.
